Terms & Conditions

These Terms & Conditions (or, “T&Cs” – as we like to call them) pave the way for how we wander together (that is, how we’ll provide our services to you).

Delivering an outstanding experience is one of our values. So, we want to get it absolutely right.

Agreeing to these T&Cs means:

  1. You know what you’re doing. You’re old enough (18 in Australia, 21 years in other jurisdictions).
  2. Things may change from time-to-time but, if they do, we’ll tell you.
  3. You’ve read and agree with our Privacy Policy.

Our Service

We connect travellers (“Client/s”), you, with local photographers in destinations around the world (“Photographers”) – to capture your beautiful travel memories (“Our Service”) in a shoot that says it all (“the Shoot”).

We have roll-over agreements with an awesome selection of Photographers hand-picked by us through seven degrees of separation for their personality, style and talent.

We contract them to help us provide Our Service.

The way we deliver Our Service, is as follows:

  1. You book your preferred Photographer through us in the destination you are travelling to, for the Package of your choice.
  2. We’ll ask a bit about why you are going on your fabulous holiday and what you hope to get from the Shoot – this helps us and the Photographer do a great job for you.
  3. We check the Photographer’s availability, and, if they are available, confirm the Shoot, usually within 48 hours; or, if the Photographer you’d prefer is not available, we’ll suggest their awesome (and like-minded) alternative.
  4. We will collect your credit card details for payment and charging.
  5. In the week prior to the Shoot, we will exchange yours and the Photographer’s contact details including, mobile number and a photograph of you (only if you want to give us one, of course) so you can find each other.
  6. You will:
    (a) pay our agreed fee for Our Services – based upon the Package selected by you; and
    (b) turn up, at least 15 minutes before the agreed time at the agreed place to meet the Photographer.
  7. The Photographer will photograph you at various locations either recommended by the Photographer or as requested by you, based upon the Package and any direction you provide. You’ll probably have a lot of fun.
  8. We’ll email you a taster photograph within a day of the Shoot to give you an idea of just how well everything is coming along.
  9. Then, within 3 days after this, we’ll upload those images making up your Package and captured at the Shoot in a custom, online album and in high-resolution, watermark free JPEG files.

Rescheduling or cancelling

We appreciate that sometimes things can go ‘a bit pear’.

If you need to reschedule a shoot, we’ll do our best but can’t guarantee anything.

If you need to cancel a Shoot, the following applies:

  1. if you give us more than 48 hours’ notice: 80% of the total cost of your Package;
  2. if you only give us less than 48 hours’ notice: no refund

If you were in absolute dire straits like a family medical emergency or the like, talk to us. We may ask to see evidence, and, will do our best to work something out. We’re reasonable people.

If it’s raining, or the weather is generally a bit dull, the Shoot is still on. Moody skies and rain drops can make for some fun, creative Images! If this is not your cup of tea, your Photographer will also know some great complete or semi-undercover locations you can make the most of.

If the rain is more like a typhoon then obviously the Shoot cannot proceed as scheduled – this could be on account of an uncontrollable event: such as said severe weather conditions, or, civil unrest – in this case we will do our best to reschedule at a time convenient to you and without penalty. Ideally as soon as possible if you are in your destination. If this is difficult we will happily credit you the value of your Package to be used within 12 months from the date of the missed Shoot, in any destination we offer.

Although we can’t think why we would, together with the Photographer, we have the sole discretion to terminate a Shoot, with a full refund to you, and to reschedule it.

Pricing and costs

We offer the following Packages:

TINY Wander

1 hour + 1 location + 20 images

SHORT Wander

1.5 hours + 1-2 locations + 35 images

AUD$490

BIG Wander

2 hours + 2-3 locations + 50 images

AUD$590

EPIC Wander

3 hours + 4 locations + 90 images

AUD$790

The package pricing advertised is inclusive of all taxes and charges.

If you would like to use a location for your shoot where there is a cost involved, you will need to pay for yourself, as well as the photographer, at the time. We’ll do our best to work this out when you book the shoot so you can plan for it.

Custom packages and special requests will happily be accommodated on a case-by-case basis and quoted accordingly.

We can arrange gift certificates that are valid to the expiry period stated on them. They are not redeemable for cash. If you obtain a gift certificate(s) unfairly, we can cancel it/them. While it will pain us if this happens to you, we are not responsible for stolen or lost gift certificates.

Wanderloud sales are final and gift certificates are not refundable.

Copyright - Rights/Licence to Use the Images

While your Images are yours to share, love, print, frame and generally do whatever you like with as you deem fit, you acknowledge that the Photographer owns copyright, and will do so for personal use only.

We will never, ever publish your image, likeness or words without your consent. We love seeing your photographs and hearing the stories that go with them but privacy is important to us. We will always ask you first before sharing, on our own behalf as well as the Photographer’s.

Additionally, you agree that you won’t use any photograph or Image from the Shoot for commercial use or profit.  You also won’t present them as your own work.

While you don’t have to, if you’re really happy with the Images and would like to share the love for Wanderloud, please do. You can do this by tagging us in any of your Images you share on social media platforms, using the hashtag #wanderloud, or creating a URL to Wanderloud.com.

Liability/Loss & Indemnity

Please don’t climb stuff or do crazy things on your Shoot. We (including the Photographer) are not responsible for any loss or damage you might incur in the provision of Our Service – including any loss arising from personal injury.

Additionally, you are responsible for agreeing to or choosing the location for the Shoot and accept any risk associated with such location.

You are also solely responsible for the security of your personal items and effects on the Shoot. We recommend you bring as little as possible to the Shoot. As in, only things that fit in your pockets. You don’t want the photographs to be of you holding your things, and you don’t want to spend the whole Shoot worrying about where you have put them down. Your Photographer will be carrying their camera equipment and own effects, and is not responsible for your possessions.

You acknowledge that the provision of and access to Our Service is on an “as is” basis and at your own risk.

We recommend you take care. As part of your responsibilities, you should consider whether you have adequate insurances in place to cover you for any loss – including personal property and travel insurance.

You agree to indemnify us (or cover us for all the costs of) meeting any claim arising from your breach of this Agreement or damage resulting, either directly or indirectly, from your use of Our Service.

Limit of Liability

Despite the above-indemnity, you specifically acknowledge and agree that the limit of our liability, if any, for any injury, loss or damage arising from the use of Our Service will be limited to the total cost of the Package ordered by you.

Use of Shoot by Someone Else

We believe sharing is caring. Once you’ve paid for a Package, it can be used to someone else nominated by you but, provided:

  1. you provide us with no less than 48 hours’ written notice, prior to the Shoot; and
  2. the recipient is at least 18 years of age.

Consumer Guarantees

We stand by the quality of Our Service and,  it’s  benefitted by consumer guarantees – prescribed under the Australian Consumer Law.

Those guarantees include that a supplier (such as us), must meet the consumer guarantees of providing services:

  • with due care and skill;
  1. which are fit for any specified purpose; and
  2. within a reasonable time (when no time is set).

We cannot ‘contract-out’ of those guarantees and they are in addition to the terms of this Agreement.

Termination

This Agreement is for a fixed service and defined event. It ends once we’ve provided Our Service to you. After it, let’s stay friends – we’d love to stay in touch.

We can also terminate this Agreement for any reason, at any time, without notice.

If we do so, we will provide Our Services to all fully paid Packages in discharge of our obligations.

Generally

This Agreement constitutes the entire agreement between us in relation to Our Service.

This Agreement will be governed by the laws of New South Wales, Australia.  You irrevocably submit to and accept unconditionally the exclusive jurisdiction of its Courts and Tribunals in respect of any claim you might make or any proceedings you might bring.

If any part of this Agreement is unenforceable or invalid, it can be severed from the balance of this Agreement and the remainder of the terms will continue to have effect.

We may assign all our rights, interests and obligations under this Agreement without first notifying you or seeking your consent.

Any failure by us to enforce a provision of this Agreement does not constitute a waiver of the benefit of that provision.

Any notice under this Agreement may be given by writing by email and will be deemed to have been given on transmission.  Notices to us can be sent to hello@wanderloud.com.  Notices will be sent to the email address provided by you with your personal information.

A person who is not a party to this Agreement has no right to benefit under or enforce any term of this Agreement.

Acceptance of T&Cs

By using Our website and booking Our Services, you agree to be bound by these T&Cs.

If you do not agree to these T&Cs, do not proceed to make a booking with Us.
